Thus the development of fiqh in a qauli manner can be done by expanding the use of fiqh rules to be used also to solve various problems related to public policy. This study uses the library research method, namely research carried out using literature (library), both data collection, in this case identifying discourse from books, papers or articles, journals, web (internet).positive law that stipulates provisions that have also been stipulated by syar''i/fiqh law as mandatory or sunnah, that the law that has implications for a case arising from a legal subject depends on the provisions in force that are in line with the case and do not conflict between the law fiqh and positive. Positive law is Positive recht which is characterized as certain regulations, and in the study of Fiqh there is also the Al-Umuru Bimaqasidiha standard, that Qawaidul Fiqhiyah plays an important role in helping to formulate regulations on issues that are not explicitly understood in the Al-Quran and Hadith.
